When you attend a Social Security disability hearing at an ODAR hearing office, one of the first questions you may have is: When will I receive a decision? Sometimes an Administrative Law Judge will make a decision on the spot, called a bench decision. If you are one of the lucky few to receive a bench decision, the judge will typically write a decision fairly quickly and you can expect a decision in the mail shortly thereafter. However, the majority of disability hearings end with the judge saying, “After careful review of the complete record, I will make a decision and you can expect the decision in the mail at a later date.”

Every judge has a different decision processing time. Some judges take as little as a few weeks to write a decision, while others can take months to do so. This is especially true for cases that are processed out of the National Hearing Center in Falls Church, Virginia. The National Hearing Center has a very large backlog of disability benefits claims and many of the judges take months to write a decision.

Unfortunately, there is not a lot that a claimant can do to “speed up” the judge’s decision. Sometimes if my law firm has been waiting for a abnormally long time for a judge’s decision, we will call an ODAR supervisor or the head of the hearing office to find out what is going on with the case. This on occasion has prompted a judge to proceed with completing the written decision.

Waiting for a judge’s decision can be a very nerve wracking experience.
